Supercharged Health is operated by Lui Do Nascimento.

For applicable data protection purposes, Lui Do Nascimento is the controller of personal information collected through Supercharged Health unless otherwise stated.

2. Information We May Collect

Depending on how you interact with us, we may collect:

Identity and contact information
such as name, email address and telephone number.

Application information
such as your objectives, circumstances, reasons for applying and information you voluntarily provide during the application process.

Programme information
such as coaching notes, agreed objectives, progress information, attendance, communications and accountability records.

Health and lifestyle information
where relevant and voluntarily provided, such as information concerning physical activity, sleep, injuries, health history, medication, nutrition or other health-related circumstances.

Payment and transaction information
relating to programme purchases and payments. Payment card information may be processed directly by a third-party payment provider rather than stored by us.

Marketing information
including marketing preferences and engagement with our communications.

Technical information
such as IP address, device/browser information and website activity where collected through permitted website technologies.

Health information can qualify as special-category personal data and receives additional protection under UK data-protection law.

3. Why We Use Your Information

We may use personal information to:

  • respond to enquiries;
  • process programme applications;
  • arrange consultations;
  • determine whether our coaching service appears appropriate;
  • enter into and administer client agreements;
  • deliver coaching;
  • personalise programme support;
  • maintain coaching and progress records;
  • communicate with clients;
  • process payments;
  • manage our business;
  • protect our legal rights;
  • comply with legal obligations; and
  • send marketing communications where permitted.

4. Our Lawful Bases

Depending upon the particular processing activity, we may rely on:

Contract — where processing is necessary to enter into or perform a contract with you.

Legitimate interests — where necessary for appropriate business administration, service improvement, security or other legitimate purposes, provided those interests are not overridden by your rights.

Legal obligation — where processing is required by law.

Consent — where we ask for and rely upon your consent.

Where we process special-category health information, we will also identify an appropriate condition under Article 9 UK GDPR. Where appropriate to our activities, this may include explicit consent.

The ICO confirms that processing special-category information requires both an Article 6 lawful basis and an applicable Article 9 condition.

5. Health Information

Please only provide health information that is reasonably relevant to your participation in the programme.

Supercharged Health is not a medical-record service, and we do not need copies of your complete medical history unless there is a legitimate and lawful reason for specific information to be provided.

Where we collect health information, we will take reasonable steps to limit collection to what is relevant and protect it appropriately.

6. Who We May Share Information With

We may use carefully selected service providers to operate the business, potentially including:

  • website hosting providers;
  • email and marketing platforms;
  • booking/scheduling platforms;
  • payment processors;
  • secure communications services;
  • cloud storage providers;
  • professional advisers; and
  • technology providers.

This may include services such as ActiveCampaign and other providers used in the final website and coaching process.

We do not sell client personal information.

7. International Transfers

Some technology providers may process information outside the United Kingdom.

Where this occurs, we will use appropriate safeguards where required by applicable data-protection law.

8. Retention

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including contractual, accounting, legal and dispute-resolution purposes.

Before publication, Supercharged Health should adopt a documented retention schedule covering at least:

Unsuccessful applications: [6 months]
Client coaching records: [6 months]
Financial records: [6 months]
Marketing records: until unsubscribe/withdrawal plus necessary suppression records.

9. Marketing

You may unsubscribe from marketing emails at any time using the unsubscribe facility included in the communication or by contacting us.

Withdrawing from marketing does not necessarily prevent us from sending necessary service communications relating to an active programme or contract.

10. Your Rights

Depending on the circumstances, UK data-protection law may give you rights concerning your personal information, including rights to request access, correction, erasure, restriction, portability or objection and, where processing relies on consent, to withdraw consent.

Some rights are subject to legal exceptions.

You also have the right to complain to the Information Commissioner's Office (ICO) if you believe your information has been handled unlawfully.

11. Security

We take reasonable organisational and technical measures designed to protect personal information from unauthorised access, alteration, disclosure, loss or destruction.

No internet-based system can be guaranteed completely secure.

12. Group Coaching

Information voluntarily disclosed by a participant during a group session may be heard by other participants.

Participants will be required to respect the confidentiality of other members.

However, because other participants are independent individuals, absolute confidentiality within a group environment cannot be guaranteed.

Clients should therefore use discretion when deciding what sensitive information to disclose during group sessions.

13. Changes

We may update this Privacy Policy periodically.

The current version and revision date will be available on our website.
